硬闖入屋催房租房東姊弟起訴

討房租也不能硬闖入屋!北市一名陳姓男子不滿租屋的蔡姓女子積欠房租和水電費卻避不見面，與胞姐深夜前往理論，見蔡女託詞洗澡不肯出面，竟將鑰匙交給胞姐開門闖入，過程全被蔡女錄音。台北地檢署調查，認為雙方租約存續中，陳姓姊弟無故闖入，依侵入住宅罪嫌起訴。

檢方指出，陳男101年7月將套房出租給蔡女，合約至102年12月底；去年9月間陳男遲沒收到房租和水電瓦斯費，多次聯繫都未獲回應，便與姊姊前往理論。

檢察官認為，房屋經出租後使用權為房客所有，房東僅是所有權人；陳姓姊弟催討可採取其他途徑，闖入並非屬正當理由，構成侵入住宅罪嫌，考量陳男提供鑰匙供姊姊開門屬幫助犯，請求法院減輕其刑。
