8歲童8公斤死亡案 母無刑責

台北地檢署偵查台北市8歲8公斤陳姓女童死亡案，法醫解剖報告出爐。報告指出，女童死前有進食，血液無毒物反應，確認女童死於「先天不足，後天失調」，獨力照顧女童的許姓婦人毋需負擔刑責。

檢方偵辦相驗案追查女童死因，朝過失致死及凌虐致死兩方向尋找答案，如果許婦沒有餵食，即涉過失責任，如積極加害女童致其死亡，即涉凌虐責任，但上午出爐的報告，檢方假設的兩種情狀均被排除。

法醫研究所報告認為，女童的身高、體重迥異於一般人，主要因素是其先天性基因異常，死因與其罹患罕見疾病有關，許姓婦人消極沒有將女兒送醫治療，不構成刑事處罰上的法律條件。

介入安置的台北市社會局日前安排許婦赴醫精神鑑定，精神鑑定報告近日可望出爐，檢方將再傳喚她與女童家屬出庭詢問對鑑定報告有無意見後，全案即可偵結。
