國民黨立委吳育昇表示，他1月7日擔任立法院程序委員會召集委員時，議事處原訂議程就沒有食管法修正草案，不是他沒將這項議案排入議程，田秋堇卻說他疑受廠商運作遊說，未將法案列入議程，涉嫌加重誹謗罪。

台北地檢署調查，食管法確實因協商沒結論，未排入院會議程，當初黨團協商函文，受文者是立委趙天麟及各政黨黨團等，不是各立法委員，可見田供稱「沒看過黨團協商函文，不知為何這次程序委員會的議程，沒有排入食管法草案」，並非不可能。

此外，田透過媒體質疑，屬善意發表言論，檢方不認為有故意詆毀吳的名譽，處分不起訴。
