高雄市54歲陳姓婦人在前金區經營附設KTV的餐廳，民國100年經工務局檢驗不合格開罰6萬元，隔年安檢設施沒改善再罰6萬元。陳姓婦人明知除非重新裝潢整治，否則不能繼續營業，卻還是隱瞞此事，將店盤讓給李姓婦人。

去年10月工務局安檢，李婦被開罰，才知店內防火避難設施不合格，認為陳姓婦人事前沒有告知她，提告詐欺罪。雄檢偵結，依詐欺罪起訴陳姓婦人。
