增訂「日月光條款」財政部原則同意

封測大廠日月光涉偷排有毒廢水事件引起社會撻伐，立委提案修法訂定「日月光條款」，只要企業爆發重大違法行為，就要暫停租稅減免優惠。財政部原則同意，但希望限定在與公益相關的環保、勞工、食安等三項法令範圍之內，避免無限上綱。

為增訂「日月光條款」，立院財委會昨審查稅捐稽徵法第48條修正草案。財政部原則同意並與提案立委達成共識，但為求與經濟部的企業獎助措施實施一致性的懲罰規定，財委會最後決定保留，擇日召開財政、經濟聯席會再審。

去年日月光K7廠爆發偷排廢水案件，引起社會大眾對政府一方面給企業鉅額補助與免稅優惠，另一方面又縱容企業違法破壞環境。立委因此提案修法。

財政部次長吳當傑表示，財政部原則上同意新增「日月光條款」，但法律除公法外，還有民法等司法，或專利法等公司法兼具的法令，範圍太廣。若因企業主觸犯私法，就一下子停止租稅獎勵，恐違反租稅公益原則。
